petitioners for issuance of writ in the nature of mandamus directing the respondent authorities to provide old pension scheme in place of contributory pension scheme treating these petitioners to have been appointed prior to 01.09.2005 for the purpose of pension, in this regard petitioners have filed representation.

Learned Counsel for the State raised preliminary objection and submits that from the representation it is clear that all petitioners have not filed the representation.

In this view of the matter, this Court is of the view that writ of mandamus cannot be issued in this matter. As such, this writ petition is disposed off with liberty to the petitioners to file fresh representation before the competent authority.
