Heard Learned Counsel for the petitioners, Learned Counsel for the State and Learned Counsel for the Bihar Public Service Commission.

The present writ petition has been filed with the following reliefs:-

“I. Whether the petitioners were appointed pursuant to the advertisement number 1 of 1990 issued by the Bihar State Subordinate Service Selection Board Patna, commonly known as the third graduate level competitive examination in which the anticipated vacancy from January 1990 to December 1993 was to be filled up will be called one transaction of selection"

II. Whether the merit list prepared by Bihar Public Service Commission in the year 1996-1997 can be treated differently for the grant of post-retiral benefit due to different

date of offer of appointment?

III. Whether the option submitted by the petitioner pursuant to the gazette notification dated 28.11.2023 is binding upon the petitioners and the State?”

Learned Counsel for the petitioners seeks issuance of mandamus and prior to that he has filed Annexures-P/6 and P/7 before the concerned authority, on which no order has yet been passed.

Learned Counsel for the State submits that passing order on representation of the petitioner is necessary.

In that view of the matter, this writ petition is disposed off directing respondent No.4, the Secretary, Information and Public Relation Department, Soochna Bhawan, Bihar, Patna, to pass order on the representation of the petitioners within 90 days from the date of receipt/production of a copy of this order.
