The present writ petition has been filed by the

petitioner for following reliefs:-

(i) for issuance of a writ/ writs certiorari or appropriate in nature for directing and commanding to the respondents to not take ancestral land of the petitioner in possession under Nagar Parishad Daudnagar District Aurangabad of the petitioner which was settled by the ex land lord in name of the ancestor of the petitioner prior to more than one hundred years and from that period the petitioner and his ancestor are coming possession over the land rent is being paid by the petitioner and name of the ancestor of the petitioner is mentioned in

Khatiyan this land is situated adjacent of Nagar Parishad Daudnagar but no this land has been acquired by the land acquisition officer Aurangabad for Nagar Parishad Daudnagar but the executive officer Nagar Parishad Daudnagar anyhow wants to take in possession of this very land and wants to make part of Nagar Parishad Daudnagar also the respondents are threating of the petitioner to take his land and make part of Nagar Parishad Daudnagar.

The grievance of the petitioner is that he is raiyat of the land in question. The ex-landlord, as per submission of the learned counsel for the petitioner, had settled the land in question in favour of ancestors of the petitioner and Nagar Parishad, Daudnagar, is interfering with the possession of the petitioner.

This is a dispute of civil nature and ultimate remedy lies before the competent civil court.

The petitioner, if so advised, may seek redressal of his grievance before the competent civil jurisdiction.

With these observations, the writ petition stands disposed of.
