Heard learned counsel for the parties.

The petitioner has approached this Court seeking a

direction upon the respondents to appoint him against the vacancies which remain vacant due to non-joining of the selected candidates in pursuance of Advertisement No. 1/2006 relating to selection of Driver-cum-Constable held in the month of March and June, 2017.

petitioner tried to persuade this Court by taking this Court through the various averments and the annexures appended to the writ petition in order to justify that the entire selection process was tinkered with various infirmities.

A counter affidavit has been filed on behalf of Respondent Nos. 5 to 7 with a categorical averment that the entire selection process was duly conducted in the manner prescribed under the advertisement in question and the merit list for the post of Driver-cum-Constable has been prepared on the basis of marks obtained in Vehicle Driving Efficiency Test. It is categorically stated that the petitioner has secured only 26 marks out of the cut-off marks of 31 in his category of BC-Male Non-Home Guard.

Mr. Binod Kumar Mishra, learned Advocate for the Central Selection Board has further contented that much water has flown under the bridge and after completion of the selection process, two other processes for appointment to the post of Driver-cum-Constable have already been completed.

Considering the submissions advanced on behalf of learned Advocate for the respective parties and taking note of the specific averment that the petitioner failed to secure the cutoff marks under his category, this Court does not find any

reason or occasion to entertain the present writ petition.
