A prayer has been made in this writ petition in

public interest for not constructing the flyover at Baijnathpur Chowk in the district of Saharsa as it would cause difficulties for the pedestrians, for they would have to travel long distances to reach the destination.

An alternative has been suggested by the petitioner that if the flyover be made on the main road, perhaps the purpose would be served and the pedestrians

also would not face any difficulty.

The prayer is without any substance.

¶32

Flyovers are constructed only to defuse the

congestion in the traffic which is identified. The apprehension of the petitioner is absolutely unfounded that with the underpass, the distance which would require

to be traversed by pedestrians would be more. In fact, when a flyover is made, the passage road remains clear to

the advantage of pedestrians and slow moving

conveyance.

There is no merit in this petition. The writ

petition is, thus, dismissed.
