The present petition has been preferred for the grant of following relief(s):

“(i) For issuance of writ of certiorari for quashing the order dated 08.08.2011 passed by D.C.L.R. Banka in Jamabandi correction case no. 12/2006-07 by which, he has observed that correction of Jamabandi is not legal correction of Jamabandi is not legal and if petitioner so wants then he may move competent court for determination of his title.

(ii) For issuance of writ of Mandamus commanding the respondent authority particularly Anchal Adhikari to trace out the Khatiyan and return of the land in question.

(iii) For issuance of writ of Mandamus commanding the respondent authority to make necessary correction in Jamabandi of the ancestral land of the petitioner.

(iv) For issuance of such other appropriate writ or order or direction which may deem fit and

proper for the ends of justice.”

Learned State counsel has taken this Court to paragraph nos. 9 and 10 of the counter affidavit filed on behalf of the Circle Officer, Barahat, Banka to show that the petitioner mainly on a basis of Khatian has filed correction of jamabandi case. The fact is that the then jamindar has already sold the land to the private respondents and several jamabandis came to be created in their favour between 1975-76 to 1987-88. He further submits that the 2011 order has been challenged in the year 2017.

Be that as it may, since there is no appearance, dismissed for non-prosecution.
