APP for the State.

¶15

The petitioners apprehend their arrest in connection with Janta Bazar P.S. Case No. 101 of 2024 instituted for the offences under Sections 341, 323, 325, 307, 504, 447 of the Indian Penal Code.

Prosecution case, in short, is that the petitioners and other accused persons assaulted the informant and his family

members by means of sword and rod, as a result, they sustained injuries.

¶19

Learned counsel for the petitioners submitted that the petitioners have falsely been implicated in the present case. Learned counsel for the petitioners submitted that general and omnibus allegation has been made against the petitioner. It has been submitted on behalf of the petitioners that the petitioners have one criminal antecedent.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioners stating that there is specific allegation against the petitioners. The prayer for grant of anticipatory bail of co-accused person has already been rejected by a coordinate Bench of this Court vide order dated 09.07.2025 passed in Cr. Misc. No. 20316 of 2025.

Considering the aforesaid facts and circumstances of the case, there being specific allegation against the petitioners and the injury sustained by the injured being grievous in nature, in my view, this is not a fit case for anticipatory bail, hence, I am not inclined to grant anticipatory bail to the petitioners.

Accordingly, the prayer for grant of anticipatory bail to the petitioners is, hereby, rejected.

However, if the petitioners surrender before the

learned court below within a period of six weeks from today and prays for regular bail, the same shall be disposed of on its own merit without being prejudiced by this order.
