APP for the State and perused the case diary.

¶11

The petitioner seeks bail in connection with Mainatand P.S. Case No. 139 of 2023, instituted for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 201 of the Indian Penal Code has been added later on.

The prosecution case, in short, is that daughter of the informant was done to death for non-fulfillment of dowry by the petitioner along with other co-accused persons.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. Charge-sheet has been submitted in this case. Learned counsel for the petitioner also submits that the petitioner is father-in-law of the deceased. No specific allegation

has been attributed against the petitioner rather the same is general and omnibus in nature. Husband of the deceased is in judicial custody. It is next submitted that the petitioner is separate in mess and business from the husband of the deceased. The petitioner is in custody since 29.09.2023 and has got no criminal antecedent. It is submitted that the trial is in progress and out of nine charge-sheeted witnesses only two witnesses have been examined in this case. Learned counsel for the petitioner further submits that other co-accused have been granted regular bail by a Co-ordinate Bench of this Court vide order dated 26.10.2024 passed in Cr. Misc. No. 58047 of 2024.

Learned APP for the State has vehemently opposed the prayer for grant of bail to the petitioner.

Considering the aforesaid facts and circumstances of the case, no specific allegation and taking into account the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- (Rupees Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Mainatand P.S. Case No. 139 of 2023, subject to the following conditions:

(I) One of the bailors shall be own/close member of

the family of the petitioner.

¶22

(II) The petitioner shall appear on each and every date

¶23

fixed at the trial. In case of default in such appearance on two consecutive dates, the Trial Court will have liberty to cancel the bail bonds of the petitioner.
