The petitioner is apprehending his arrest in connection with Complaint Case No. 264 of 2024 for the offence under Sections 420, 467, 468 and 34 of the I.P.C.

As per the prosecution story, the informant has alleged that the present petitioner in connivance with other coaccused, got the sale deed executed in his favour with respect to the land which belongs the complainant.

Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. After the death of complainant’s father, he and his two sisters (vendor of the petitioners) orally partitioned the lands of

their father amongst themselves since long back. In oral partition, both the sisters of the complainant got four bighas of land each out of total 20 bigha and accordingly they were in peaceful possession over their shared land. Thereafter, one sister of the complainant namely Bibi Hajra (co-accused) sold some part of her shared land measuring 14.5 decimal to the petitioner by virtue of registered sale deed no. 565 dated 20.01.2024 and since the date of purchase, petitioner is in peaceful possession of the land.

Learned APP opposes the prayer for bail.

Keeping in view the fact that petitioner is bona fide purchaser of the land after giving the consideration amount and considering the fact that this is purely a Civil dispute as also the clean antecedent of the petitioner, this Court is inclined to extend him the privilege of anticipatory bail.

Let the petitioner be released on bail in the event of arrest or surrender within a period of four weeks from the date of receipt of this order, on furnishing bail bond of Rs. 10,000/(Ten thousand) each with two sureties of like amount each to the satisfaction of learned Judicial Magistrate 1^st Class, Banka, in connection with Complaint Case No. 264 of 2024 subject to the conditions as laid down under Section 482 of B.N.S.S., as also

with the condition that one of the bailors should be close
