The present Civil Miscellaneous application has been filed against the order dated 13.07.2023 by which the petition filed on behalf petitioner/plaintiff in Title Suit No. 584 of 2019 for analogous trial of two Title Suits i.e., Title Suit No. 584 of 2019 and Title Suit No. 1224 of 2014 which are pending before the Court of learned Sub-Judge-I, Vaishali at Hajipur and learned Sub-Judge-X, Vaishali at Hajipur respectively has been rejected.

Learned counsel for the petitioner submits that in

the above two Suits, Suit property and contesting parties are same but the relief sought for in both the plaints are different.

For proper and complete adjudication of the suit, as well as for the sake of convenienc, analogous trial is essential. Both the parties are directed to file a petition before the learned District and Sessions Judge, Vaishali at Hajipur who may pass an order with regard to analogous trial of the aforesaid suits after hearing both the parties.
