The petitioner apprehends her arrest in connection with Hathauri P.S. Case No. 157 of 2024 dated 25.08.2024 registered under Sections 103(1), 238, 3(5) of the B.N.S. 2023.

As per the first information report the daughter of the informant eloped with the co-accused Ram Kumar Sah and performed love marriage for which the complainant lodged Hathauri P.S. Case No. 129 / 2024. After recovery of the informant’s daughter, she was handed over to her husband and started residing with her in-law. It has further been alleged that suddenly last night i.e. on 24^th August 2024 the informant got information that the petitioner in collusion with other accused persons killed her daughter by strangulation and later on hanged

her body on bamboo to make it a case of suicide.

Mr. N.K. Agrawal, learned senior counsel for the petitioner submits that petitioner is the mother-in-law of the deceased and has falsely been implicated in this case. The deceased and the petitioner’s son co-accused / Ram Kumar Sah solemnized love marriage and were living in the village. The husband was working outside at Delhi and the deceased insisted her husband that she should be kept at Delhi along with him but the deceased’s husband went Delhi alone due to which the deceased has committed suicide. The husband of the deceased was doing the labour work at Delhi and was not in a position to keep his wife with him due to financial constraint. Due to dispute between husband and wife the deceased has committed suicide. During course of investigation the witnesses have said that the deceased wanted to live with her husband at Delhi but the husband did not agree for the same as such she has committed suicide. The husband is in custody since 11.02.2025.

Regard being had to the submission made by the parties, taking into consideration the fact that the husband of the deceased is in custody and the petitioner is the mother-in-law of the deceased, accordingly, I am inclined to grant anticipatory bail to the petitioner.

Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M.F.C., Muzaffarpur East in connection with Hathauri P.S. Case No. 157 of 2024 subject to the condition as laid down under Section 482 (2) of the B.N.S.S. 2023.
