The instant application for anticipatory bail has been filed by the petitioners apprehending their arrest in connection with Shahpur P.S. Case no. 142 of 2024 instituted for the offence under Sections 420, 468, 471, 34 of the IPC corresponding to Section 318(4), 336(3), 340(2), 3(5) of Bharatiya Nyay Sanhita 2023.

As per allegation in the FIR, informant submitted an application on 08.02.2024 before the police about sale of her land by the antisocial elements. It is alleged that on 27.02.2024,

informant learnt that petitioners have sold her land measuring five katha pertaining to Mauza Jaipur Hathiakand, Khata No. 278, Plot No. 66.

Learned counsel appearing on behalf of the petitioners have submitted that petitioners are innocent and have committed no offence. Petitioners have got no criminal antecedent. Learned counsel further submits that petitioners admit that they have sold the land falling in their share and they have not sold the land of the informant. Petitioners have annexed genealogical table as annexure P/2 from which as per the submission, petitioners are the son of late Ramvaran Singh whereas informant is the son of late Ramsharan Singh both being own brother and co-sharer of the suit property. He further submits that for the alleged occurrence informant has filed title suit no. 241 of 2024 on 28.05.2024 for cancellation of said sale deed which is pending before learned Sub-Judge-1, Danapur. So, there is bona fide land dispute between the parties.

Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioners on bail. The petitioners are directed to surrender in the Court below within a period of four weeks from today and in the event of their arrest

or surrender in connection with Shahpur P.S. Case no. 142 of 2024, they will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned SDJM, Danapur or his successor subject to the conditions as laid down under section 438(2) of the Cr.P.C.
