Heard learned Advocate appearing on behalf of the petitioner and the learned Additional Public Prosecutor for the State.

The petitioner apprehends her arrest in connection with Ghatho P.S. Case No. 54 of 2024, registered for the offences punishable under Sections 191(2), 190, 126(2), 115(2), 303(2), 109, 74, 352 and 351(3) of the Bharatiya Nyaya Sanhita.

On the fateful day, the petitioner alongwith other accused persons came to the house of the informant and started abusing and assaulting the informant and others. The petitioner allegedly abused and assaulted the informant and others.

Learned Advocate appearing on behalf of the petitioner submitted that the petitioner is a woman having fair antecedent, however only with a view to wreck vengeance and

put pressure, her name has been implicated in this case. Other co-accused persons who are facing identical allegations, have been allowed the privilege of anticipatory bail. The copies of the orders have been placed on record as Annexure P/2 series. It is further submitted that in fact it is the prosecution side who assaulted the persons of the petitioner’s side, for which Ghatho P.S. Case No. 57 of 2024 has been instituted. The petitioner undertakes that she will fully cooperate in the proceeding of the Court.

On the other hand, learned Advocate for the State vehemently opposed the pre-arrest bail application and submits that the petitioner has also actively participated in the crime.

Having considered the submissions advanced by learned Advocate for the respective parties and taking note of the fact that other co-accused persons having identical allegation have been allowed the privilege of anticipatory bail and the case of the petitioner stands on similar footing, besides she is a woman, let the petitioner above named be released on bail, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of

the learned Additional Chief Judicial Magistrate-I, Dalsingsarai, Samastipur in connection with Ghatho P.S. Case No. 54 of 2024, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023 with the further condition that one of the bailors shall be the own/close family members of the petitioner.
