Heard the learned Advocate for the petitioners and the

learned Additional Public Prosecutor for the State.

The petitioners are apprehending their arrest in connection with Hasanpur P.S. Case No. 19 of 2025, registered for the offences punishable under Sections 126(2), 115(2), 352, 351(3), 109 and 189(2) of the B.N.S. and Section 27 of the Arms Act.

Allegedly on the fateful day, while the children of the informant were returning from school, all the accused persons, including the petitioners, surrounded them and

assaulted by means of stick, lathi , danda and pistol. The petitioners and others, later on also rushed to the house of the informant and also threatened with dire consequences and resorted to firing.

Learned Advocate for the the petitioners submitted that on account of a dispute arisen amongst the children, the present occurrence has taken place, resulting into some unfortunate injuries. However, the injuries which are allegedly sustained to the children and others, all of them have been found to be simple in nature. Moreover, the parties are neighbours and only on trifle, they have entered into scuffle. There is a counter version of the present case being Hasanpur P.S. Case No. 20 of 2025 instituted against the informant and others. It is lastly submitted that the petitioners bear fair antecedent and they undertake that they will fully co-operate in the proceeding of the Court.

On the other hand, learned Advocate for the State opposed the pre-arrest bail application and submits that the petitioners have brutally assaulted the children of the informant, besides the allegation of firing and threatening.

Having considered the submissions advanced by learned Advocate for the respective parties and taking note of

the genesis of the occurrence, coupled with the factum of case and counter case, besides the fair antecedent of the petitioners and the simple nature of injury, let the petitioners above named be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, upon furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-IV, Rosera, Samastipur in connection with Hasanpur P.S. Case No. 19 of 2025, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023 with the further condition that one of the bailors shall be the own/close family members of the petitioners.
