The petitioner seeks bail in connection with Ujiarpur P.S. Case No. 314 of 2023 dated 20.08.2023, instituted for the offence punishable under Sections 302, 201, 34 of the Indian Penal Code.

The prosecution case, in short, is that on 20.08.2023, the informant received an information from the villagers that his daughter has been hanged to death. When the informant reached the matrimonial house of his daughter then he found his daughter lying dead on a ‘chowki’. It is alleged that petitioner along with other accused persons have killed his daughter. It is further alleged that 2-3 months ago, Ramashish Paswan demanded five lakhs from the informant and threatened

to kill his daughter, if he fails to pay the same.

Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. It is further submitted that petitioner is the elder brother of the husband of the deceased. It is also submitted that marriage of the daughter of informant was solemnized in the year 2013 and the occurrence took place after 10 years of marriage and, as such, the demand of dowry is prima facie false allegation. It is next submitted that the daughter of the informant committed suicide by hanging herself and when this fact came to the knowledge of informant then he filed a compromise petition. It is further submitted that similarly situated co-accused person namely, Ramashish Paswan and Ramkashi Devi have been granted bail vide order dated 02.07.2024 passed by a Coordinate Bench of this court in Criminal Miscellaneous No. 45126 of 2024. Lastly, it has been submitted that the petitioner is in custody since 22.07.2024 having no criminal antecedents and charge-sheet has been submitted in the case.

Learned A.P.P. has opposed the prayer for bail of the petitioner.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let

the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Samastipur in Ujiarpur P.S. Case No. 314 of 2023.
