Heard learned counsel appearing on behalf of the

petitioner and the learned APP for the State.

Petitioner seeks pre-arrest bail in connection with

Mehsi P.S.Case No.01 of 22, registered for the offences punishable under Sections 341, 323, 324, 379, 307, 504 and 506/34 of the Indian Penal Code.

As per the allegation made in the FIR, the petitioner along with the other accused persons assaulted the informant and his father with knife, as a result, they sustained injury. It is further alleged that the petitioner snatched Rs.50,000/- from the pocket of the informant.

Learned counsel appearing on behalf of the petitioner submitted that the petitioner and the informant are agnates and the injury sustained by the informant and his father is simple in nature.

Learned APP for the State vehemently has opposed the prayer for grant of pre-arrest bail to the petitioner.

Having considered the rival submissions made on behalf of the parties, as well as, considering the fact that the petitioner and the informant are agnates and the injuries of the informant and his father are simple in nature, the petitioner is directed to be released on pre-arrest bail, in the event of his arrest or surrender before the learned district court within a period of four weeks from today, on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned CJM, East Champaran, Motihari/concerned court, in connection with Mehsi P.S.Case No.01/22 subject to conditions as laid down under Section 438 (2) of Cr.P.C.

The learned district court is directed to verify the criminal antecedent of the petitioner and if it is found that the petitioner is involved in some other cases as what has been stated in paragraph No.3 of the bail application, this order will automatically lose its force.
