The petitioners have prayed for grant of bail in connection with Janta Bazar P.S. Case No. 134 of 2024 registered under sections 331(4) and 305(a) of the B.N.S.

The case of the prosecution is that on 18.07.2024 at

about 7 P.M. the informant closed his jewellery shop situated in his house and went to Delhi to attend a marriage ceremony on 17.07.2024 at about 1 P.M. after he opened his house and found that the back door of the house, three almirah and two boxes were broken. The informant suspects that unknown miscreants have committed theft of different jewellery and valuables amounting to rupees 14 lakhs.

Learned counsel for the petitioners submits that the petitioner are innocent and have committed no offence. They have falsely been implicated in this case. Petitioner are not named in FIR rather the name of the petitioners have been surfaced in para-25 of the case diary where the informant has suspected the name of these petitioners. In this case petitioner Dinesh Kumar has given his confessional statement and in his confessional statement, he has named the petitioner Deepu Kumar. It has been submitted by learned counsels for the petitioners that nothing has been recovered from the possession of these petitioners and also no T.I parade has been conducted in this case. Police has also submitted charge sheet. Moreover, the petitioners are languishing in judicial custody since 23.07.2024 and 04.11.2024 respectively.

for the State and submitted that petitioner Dinesh Kumar has three criminal antecedents whereas petitioner Deepu Kumar has one criminal antecedent.

Having heard learned counsel for the parties and considering the facts and circumstances of this case, the Court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail in connection with Janta Bazar P.S. Case No. 134 of 2024 on each of them furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned First Class Judicial Magistrate, Chapra, Saran.
