Heard learned senior counsel for the petitioner and

learned APP for the State.

In the present case, the petitioner seeks bail in connection with Gaya Muffasil P.S. Case No. 74 of 2024, registered for the alleged offences under Sections 302/201/34 of the Indian Penal Code.

The informant gave written report about the petitioner and seven other co-accused persons killing her husband and in order to tamper with the evidence, hanging her dead body. The informant alleged about occurrence taking place in the background of some monetary dispute between her husband and petitioner and other co-accused persons.

the petitioner submits that the petitioner has been falsely implicated in this case and this fact is apparent from the written report itself. A number of incidents have been mentioned to make out a case against the petitioner and other co-accused persons. No specific allegation has been levelled against the petitioner. During investigation, the witnesses have been examined and independent witnesses stated about the husband of the informant committing suicide after some altercation with the informant. It is not believable that over some petty quarrel, the petitioner would murder the husband of the informant. The post mortem report also shows it is a case of suicide and not of murder. The learned senior counsel further submits that the petitioner is having criminal antecedents of three cases. The petitioner is in custody since 21.05.2024 and charge sheet has been submitted.

Learned APP vehemently opposes the submission made on behalf the petitioner.

Having regard to the facts and circumstances and submission made on behalf of the parties and considering the doubtful nature of allegation against the petitioner and further considering the period of custody of the petitioner and

submission of charge sheet, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IX, Gaya/court concerned, in connection with Muffassil P.S. Case No. 74 of 2024, subject to the conditions mentioned in Section 437 (3) of the Code of Criminal Procedure and also the following conditions :

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
