The petitioner seeks regular bail in a case registered under Sections 274, 275, 3(5) of the Bharatiya Nyaya Sanhita and Sections 30(a), 30(b) and 30(c) of Bihar Prohibition and Excise Act.

As per the prosecution case, 87.375 litres of illicit liquor, 50 litres of spirit, 384 empty bottles, caps wrappers and two alcohol meters were recovered from the place of occurrence. Two accused persons namely Rakesh Kumar and Ravi Ranjan Kumar @ Anil Kumar were apprehended on the spot who disclosed the name of the petitioner and other accused persons that they are involved in business of illicit liquor. the wrappers.

Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case on the disclosure statement of the apprehended co-accused with whom petitioner has no concern. Further submission is that petitioner was not present on the spot and he has no concern with the seized materials. Nothing has been recovered from conscious possession of the petitioner. Petitioner has two criminal antecedents. The charge-sheet has already been submitted after completion of investigation. There is no chance of his absconding or tampering with the evidence. Similarly situated co-accused persons, namely, Rakesh Kumar and Ravi Ranjan Kumar @ Anil Kumar have already been granted regular bail by a Co-ordinate Bench of this Court vide orders dated 24.09.2025 passed in Cr. Misc. Nos. 68690 of 2025 and 66976 of 2025. Petitioner is in custody since 07.08.2025 and he undertakes to cooperate in the trial.

Learned APP for the State has opposed the prayer for regular bail of the petitioner.

Considering the facts and circumstances of the case, the submissions of learned counsel for the parties and period of custody, let the petitioner, above named, be released

on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned in connection with Hathauri P.S. Case No.124 of 2025 with further conditions:-

(i) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bond by the Trial Court itself;

¶23

(ii) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidence, failing which the State shall be at liberty to take steps for cancellation of the bail bond;

¶24

(iii) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of his bail bond.
