The petitioner seeks regular bail in connection with Paliganj P.S. Case No. 9 of 2024, lodged on 04.01.2024 under Sections 304B, 201, 34 of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act.

As per the prosecution case, the F.I.R. has been lodged against five named accused persons including the present petitioner against whom there is an allegation that all the accused persons in connivance with each other have killed the daughter of the informant who is the wife of the present petitioner.

Learned counsel for the petitioner submits that the

petitioner is innocent and has committed no offence. The antecedent of the petitioner is not clean as he is accused in one other criminal case, but in that case, he is on bail. Learned counsel further submits that in fact, the victim committed suicide and information was given to the informant's family about the said incident who participated in the funeral also, but maliciously the present accusation has been levelled. He further submits that from the said wedlock, a female child was born, and she is currently residing with the family members of the petitioner. Petitioner is in custody since 11.01.2024 and now more than one year has lapsed, but no development has taken place in this case till date.

Learned counsel further submits that on earlier occasions while calling for the case diary and injury report, a report with regard to the present stage of the trial has been called for and as per his knowledge, till date charge has not been framed.

Learned counsel for the State opposes the prayer

Learned counsel for the informant on the other hand opposes the prayer for bail and submits that the present F.I.R. has been lodged under Section 304B and other allied

sections of the Indian Penal Code. In paragraph 89 of the case diary, the behaviour of the petitioner has been explained by the local people. He further submits that in paragraph 102 of the case diary, brother-in-law (bahnoi) of the petitioner has stated that the petitioner along with other accused persons used to inflict torture and assault the daughter of the informant. Learned counsel further submits that the cremation of the victim’s dead body was carried out without informing the family members of the victim or other concerned persons.

In the present facts and circumstances, I am not inclined to grant regular bail to the petitioner.

Accordingly, the prayer for regular bail of the petitioner in connection with Paliganj in connection with Paliganj P.S. Case No. 9 of 2024, pending before the learned S.D.J.M., Danapur, Patna is hereby rejected.
