REGULAR BAIL GRANTED ON RENEWED PRAYER: The Patna High Court (Criminal Miscellaneous No.68059 of 2025, oral order dated 19-09-2025, Ashok Kumar Pandey, J) enlarged petitioner Sagar Chaudhary on bail in connection with Sohsarai P.S. Case No. 171 of 2024 (Thana SOHSARAI, District Nalanda), registered for offences punishable under sections 103 and 3(5) of the B.N.S. and Section 27 of the Arms Act. His earlier prayer for bail had been rejected vide order dated 11.02.2025 in Cr. Misc. No. 88244 of 2024 with an observation that he could renew the prayer after six months. Counsel submitted that the only allegation against the petitioner was that he gave the gun to Dharmendra Chaudhary, who fired, the firing itself not being alleged against him; that he had no criminal antecedent; and that he was in judicial custody since 20.07.2024. Learned APP opposed the prayer. Considering the facts and circumstances, release was directed on furnishing a bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned District and Additional Sessions Judge, 2nd, Nalanda at Biharsharif.

Heard learned counsel for the petitioner and learned APP for the State.

The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 103 and 3(5) of the B.N.S. and Section 27 of the Arms Act which was earlier rejected vide order dated 11.02.2025 passed in Cr. Misc. No. 88244 of 2024 with an observation that the petitioner may be at liberty to renew his prayer for bail after six months.

Learned counsel for the petitioner has submitted that the only allegation against this petitioner is that he has given the gun to Dharmendra Chaudhary and he has fired. Allegation of firing is not against this petitioner. A statement has been made in para-3 of this petition that the petitioner has
