Heard learned counsel for the petitioner and learned APP for the State.

The petitioner is in custody in connection with Lakhnour P.S Case No. 17 of 2025 registered for the offences punishable under Sections 310(2) of the B.N.S 2023.

As per prosecution case, it is alleged that petitioner along with co-accused have looted Rs. 106,000/- and silver and gold ornaments from the temple.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. It is further submitted that petitioner has got four criminal antecedent . It is also submitted that petitioner is in judicial custody since 09.04.2025.

However, learned APP for the State oppose the prayer for regular bail of the petitioner.

On perusal of the FIR and impugned order, it appears that petitioner is in custody since 09.04.2025. Name of the petitioner surfaced from the self-confessional statement of the petitioner but no recovery from the possession of the petitioner. It is also appears that investigation is already concluded and from perusal of the paragraph no. 8 of the case diary it seems that no witness have identified the present petitioner.

Considering the aforesaid facts and circumstances of the case and submissions made on behalf of the petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M 1^st , Jhanjharpur, Madhubani in connection with Lakhnour P.S Case No. 17 of 2025, subject to the condition that petitioner shall remain present physically before trial Court on each and every dated fixed by the trial Court till conclusion of the trial.
