A.P.P. for the State in all the aforesaid three cases.

The petitioners seek bail in Murar P.S. Case No. 37

of 2025, registered for offence punishable under Sections 310(2), 317(3), 111 of the B.N.S., 2023.

Prosecution case, in brief, is that, on 17.05.2025 at about 01:00 am (night), informant was returning home on motorcycle with his video camera and reached near Sajan Brick Kiln, three miscreants each riding on two motorcycle stopped him and started assaulting him. One of the accused put katta on informant’s head and snatched his gold locket, Rs. 700 cash and video camera and also threw his motorcycle key in bushes and fled away from the spot. It is further alleged that at 02:20 am, the informant received an information that all miscreants have been caught. Thereafter, informant reached there and found four accused persons, whereas two accused fled away. The accused persons disclosed their name as Ravi Kumar (co-accused), Anish Kumar @ Raj (petitioner in Cr.Misc. No. 59913/25) and Ravi Kumar & Anjit Sahara (petitioners in Cr.Misc. No. 60592/25) and also disclosed the name of two persons who fled away as Nitish Kumar (co-accused) and Dipu Kumar (petitioner in Cr.Misc. No. 59049/25).

Learned counsel for the petitioner (Dipu Kumar)

submits that petitioner has been implicated in this case on the basis of confessional statement of co-accused persons, who were apprehended on spot. Till date, petitioner has not been put on T.I.Parade. Petitioner, having clean antecedent, is in custody since 19.05.2025.

Learned A.P.P. for the State vehemently opposes the prayer for bail of petitioner (Dipu Kumar) and submits that apprehended accused persons disclosed the name of this petitioner and on the disclosure of this petitioner, video-camera of informant was recovered.

Considering the same, the prayer for bail of petitioner is rejected. However, as petitioner is in custody since 19.05.2025, the learned trial court is directed to expedite the trial.

Learned counsel for the petitioners submits that petitioners were arrested in this case only on suspicion. They have committed no offence. No incriminating article has been recovered from conscious possession of these petitioner.

Petitioners have got clean antecedent and are in custody since 19.05.2025

Considering the aforesaid facts and circumstances as well as period of custody and clean antecedent, both the bail petitions i.e. Cr.Misc. Nos. 59913/25 & 60592/25 are allowed.

Accordingly, let the petitioners of aforesaid two cases namely Anish Kumar @ Raj, Ravi Kumar and Ajit Sahara @ Anjit Sharma be released on bail on furnishing bailbonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., District - Buxar in connection with Murar P.S. Case No. 37 of 2025.
