Petitioner apprehends arrest in a case registered for the offence punishable under Section 30(a), 32(3) of the Bihar Prohibition and Excise Act.

As per the prosecution case, 45 liters country made liquor was recovered from a motorcycle, of which, this petitioner is owner.

Learned counsel appearing for the petitioner submits that he has been falsely implicated in this case. As he is owner of the motorcycle, he has been falsely implicated in this case. The petitioner is 74 year old hence he is not able to drive the motorcycle. The seized motorcycle was given to others to

go to the house of relative. No incriminating material has been recovered from conscious possession of the petitioner and he is no way connected with the aforesaid recovery. The petitioner claims clean antecedent.

Learned A.P.P. for the State submits that 45 liters illicit liquor was recovered from a motorcycle of which the petitioner is owner.

Considering the recovery of huge quantity of liquor and the fact that petitioner is owner of the seized motorcycle, anticipatory bail application of the petitioner is rejected.
