Heard learned counsel for the petitioner and learned APP for the State.

The petitioner has prayed for bail in connection with Delha P.S. Case No. 210 of 2023 registered for the offence punishable under Sections 366(A) and 34 of the Indian Penal Code.

The case of the prosecution is that the petitioner along with other has kidnapped the daughter of the informant.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. During course of investigation, the victim was recovered and she has given her statement under Section 183 of the

B.N.S.S. wherein though she has stated that she was being kidnapped by three boys and was taken to Surat by one boy but she has not named anyone. It has also been submitted that as the victim has not named the petitioner, there is no allegation against him and the F.I.R. is based only on suspicion. Petitioner is having no criminal antecedent and he is languishing in judicial custody since 08.05.2025.

Learned APP appearing for the State has vehemently opposed the application for bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-I, Gaya in connection with Delha P.S. Case No. 210 of 2023.
