Heard Mr. Md. Qumrul Hoda, learned counsel for the Petitioner and Mr. Yogendra Kumar, learned APP for the State.

2. Petitioner seeks regular bail in connection with Barsoi P.S. Case No. 122 of 2024 dated 13.06.2024 registered for the offences punishable under Sections 420, 379, 411 and 414 of the Indian Penal Code.

The main submissions advanced by the petitioner's counsel are that the name of this petitioner came into light in the statement of co-accused, Sanjeev Kumar Sharma, recorded by him in connection with Barsoi P.S. Case No. 58 of 2024 before the police and two stolen motorcycles are said to have been recovered from the house of said co-accused but nothing

incriminating or theft motorcycles or any other material was recovered either from the conscious possession of the petitioner

or from his house, and against this petitioner except the statement of co-accused, Sanjeev Kumar Sharma, there is nothing to connect the petitioner with the alleged offence and such statement by itself has no evidentiary value. It is further submitted that the petitioner has been languishing in jail since 09.06.2024 and till date his trial has not started and in this regard, trial court’s order may be perused. It is lastly submitted that though against the petitioner there are criminal antecedent of three cases, however, he has been acquitted in one of these antecedent cases and in rest cases, he is on bail.

4. Learned APP appearing for the State has opposed the prayer for bail of the petitioner.

Considering the aforesaid submissions and mainly petitioner's custody period in the present matter and also the fact that in respect of the petitioner’s involvement in the alleged offences, the police are mainly relying upon the statement of coaccused Sanjeev Kumar Sharma as stated above which has not been refuted by learned APP, in my opinion, it is a fit case for bail to the petitioner. Accordingly, let the petitioner namedabove be released on bail on furnishing bail bond of Rs.

20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Barsoi P.S. Case No. 122 of 2024.
