Heard learned counsel appearing on behalf of the

petitioner learned A.P.P. for the State.

The accused/petitioner seeks bail in connection with

¶14

Kashichak P.S. Case No. 89 of 2025 registered for the offences under Sections 303(2), 318(2), 318(4), 338, 319(2), 336(3), 340(2), 111, 61(2), 3(5) of the Bhartiya Nyay Sanhita, 2023

(in short, the ‘B.N.S.’) and 66, 66(C), 66(D) of the I.T. Act.

The accused/petitioner is named in the First

Information Report and is in custody since 26.05.2025.

¶18

As per FIR, on 25.05.2025 at about 12 p.m. the

¶19

informant received an information that some persons have indulged in committing cyber fraud, whereafter upon police raid,

8-10 persons were found indulged in committing cyber fraud

¶21

and seeing police party, they were trying to flee away, however,

¶22

police after chase apprehended two persons including this petitioner.

It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is a man of rural background and therefore upon seeing police, he started to run away, but apprehended by police under suspicion that he was the person who might be indulged in cyber fraud. It is submitted that nothing transpires during investigation to suggest that mobile phone which was seized from the petitioner i.e. 9798392067/9835805133 was involved in alleged cyber fraud.

It is further submitted that save and except suspicion, nothing incriminating was found against this petitioner during entire investigation.

While concluding argument, it is submitted that petitioner is a man of clean antecedent and, moreover, investigation of this case is already completed, charge-sheet has been submitted and as such, there is no chance of tampering with the evidence.

Learned A.P.P. for the State has opposed the prayer

for bail of the petitioner.

In view of the aforesaid factual submission and by

taking note of the fact as except suspicion out of conduct of petitioner as mentioned aforesaid, nothing prima facie appears incriminating during investigation as to connect the petitioner with the alleged cyber fraud, coupled with the fact that petitioner remains in custody since 26.05.2025, where investigation of this case is already completed, accordingly, above-named petitioner is directed to be released on bail, furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - VI, Nawada/concerned court, in connection with Kashichak P.S. Case No. 89 of 2025, subject to the condition as laid down under Section 437(3) Cr.P.C/Section 480(3) of the Bhartiya Nagarik Suraksha Sanhita (in short “B.N.S.S.”).

Accordingly, this application stands allowed.
