Heard learned counsel for the petitioner and learned

A.P.P. for the State.

The petitioner seeks regular bail in a case registered under Sections 30(a) and 41 of Bihar Prohibition and Excise Act.

As per the prosecution case, 4225.32 litres of illicit liquor was recovered from the truck bearing Reg. No. UP23-AT0284 and the petitioner, who was a driver of the said truck, apprehended whereas two other co-accused persons fled away from the place of occurrence.

Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case being the driver of the seized truck. Further submission is that petitioner was not aware with respect to the seized liquor

kept in the truck. Petitioner has no concern with the seized liquor. Nothing has been recovered from conscious possession of the petitioner. The charge-sheet has already been submitted after completion of investigation. Petitioner has clean antecedent and there is no chance of his absconding or tampering with the evidence. Petitioner is in custody since 27.06.2025 and he undertakes to cooperate in the trial.

Learned A.P.P. for the State has opposed the prayer for regular bail of the petitioner.

Considering the facts and circumstances of the case, the submissions of learned counsel for the parties and period of custody, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned in connection with Ahiyapur P.S. Case No.887 of 2025.
