The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 103(1), 238 and 3(5) of the B.N.S.

The case of the prosecution in short is that the daughter of the informant, namely, Sunita Devi (deceased) was married to the petitioner. It is alleged that on 27.08.2024 at 11 A.M., the informant received information that the petitioner and his brother have assaulted the deceased and in night at 10 P.M., she was being killed and thrown in Gandak river. When the informant came to the matrimonial house of the deceased he found that the house was closed.

that from perusal of the post-mortem report it is clear that Doctor has not assigned any reason, any cause of death rather viscera has been preserved. No antemortem injuries were found on the person of the deceased. Learned counsel for the petitioner has submitted that allegation regarding assault gets falsified from the post-mortem report. Learned counsel for the petitioner has lastly submitted that the petitioner is a man of clean antecedent and is in judicial custody since 29.08.2024.

Learned Additional Public Prosecutor for the State has vehemently opposed the prayer of bail to the petitioner.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Parsa P.S. Case No. 282 of 2024 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions JudgeXVII, Saran at Chapra.
