Heard Mr. Ajit Kumar Singh, learned counsel for the petitioner in Cr. Misc. No. 50261 of 2025 and Mr. Amit Kumar Singh, learned counsel for the petitioner in Cr. Misc. No. 53714 of 2025 and the State.

under Sections 317(4), 317(5) and 111 of the B.N.S. lodged on 02.05.2025 by the informant, Anupam Raj.

As per the informant, a Police Officer stationed with the Purnea Sadar Police Station, upon information that Navin Kumar (petitioner in Cr. Misc. No. 50261 of 2025) is involved in number of thefts/house breakings, after constituting a team, apprehended him. He made confession that alongwith his sister, Arti Kumari who does the ‘ recce’ of the houses alongwith Babli Kumari (petitioner in Cr. Misc. No. 53714 of 2025) and her husband, Prem Kumar have constituted a group who commit theft. He also confessed to the theft that took place on 13.04.2025 at a house near Doon Public School and on 18.04.2025 in another house behind the Bandhan Bank.

It was confessed that the amounts were distributed amongst themselves and the rest can be seized from his house. Accordingly, the place was raided and numbers of items were recovered/seized which include gold/silver ornaments, cash, watches and under the mango tree some mobiles/sims were recovered/seized. This followed raid in the house of Prem Kumar/Babli Kumari and from there also, huge recovery, as recorded above, were made. The accused got the information and managed to escape but later, were apprehended and

confessed to the crime as narrated by Navin Kumar (petitioner in Cr. Misc. No. 50261 of 2025). This followed the FIR.

Learned counsel for Navin Kumar concede that he has criminal antecedent whereas learned counsel for Babli Kumari submits that she has no criminal antecedent and all the articles/seized items belonged to them.

Learned APP in both the cases have once again taken this Court to the FIR to show that the recovery/seizure of the articles/mobile phones/SIMS/cash certainly cannot be attributed to the accused persons and Court has to take note of the fact that they have criminal antecedent.

A perusal of the petition of Babli Kumari shows that in paragraph-3 it has been recorded that she has no criminal antecedent.

However, the learned Sessions Judge has recorded that in paragraph -31 of the case diary, the criminal antecedent of Babli Kumari is available. When the said observation is available in the order sheet of the learned Sessions Judge, it is clear that the learned counsel for the petitioner, Mr. Amit Kumar Singh either has not gone through the learned Sessions Judge order or has deliberately tried to suppress this fact from the Court to procure bail which is deprecable.

Considering the submissions of the parties as also the materials available on record and the seizure/recovery that have been made, this Court, for the present, is not inclined to extend privilege of bail to the petitioners.
