counsel for the informant and learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Danapur P.S. Case No. 268 of 2024, instituted under Sections 341, 342, 323, 379, 384, 385, 504, 506, 34 of the Indian Penal Code.

As per the prosecution case, on the date of occurrence when informant with an engineer and labourers and mistry came at the site for getting work done, F.I.R. named accused persons having armed with lathi , bhala and gun came there and started abusing and assaulting the labourers and mistry . The accused persons also demanded extortion money from the informant.

Learned senior counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. The offences are triable by the Magistrate. It is further submitted

that petitioner is MBBS Doctor and is also a Ward Councillor of Ward No. 15. Due to land dispute petitioner has been implicated in seven cases. Similarly situated co-accused persons have already been granted anticipatory bail by this Court vide order dated 06.09.2024 passed in Cr. Misc. No. 40035 of 2024. Petitioner undertakes to co-operate in the investigation and trial.

Learned A.P.P. for the State and learned counsel for the informant oppose the prayer for anticipatory bail.

Considering the facts and circumstances of the case and submission of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-I, Danapur in connection with Danapur P.S.
