Heard Mr. S. Jamil Akhter, learned counsel for the petitioners and Mr. Narendra Kumar Singh, learned APP for the State.

2.The instant application for anticipatory bail has been filed by the petitioners apprehending their arrest in connection with Sherghati P.S. Case No. 546 of 2024 instituted for the offence under Sections 126(2), 115(2), 109, 191(2), 190, 238, 352 and 351(2) of B.N.S.

The case of the prosecution is that the husband of the informant was on guard duty. At that time as he reached near dump, he found that the petitioners along with others being

armed with weapon were attempting to carry the sand dump. When the husband of the informant objected, he was being badly assaulted by the accused persons. It is further alleged that the husband of the informant is serious and he is admitted in A.N.M.C.H. In the last portion of the F.I.R., it has been alleged that the husband of the informant was assaulted as he has objected the accused persons in operating D.J.

Learned counsel appearing on behalf of the petitioners has submitted that petitioners are innocent and have committed no offence. They have falsely been implicated in this case. It has further been submitted that from perusal of the injury report, it will transpire that the victim has received three injuries out of which, one is grievous. It has also been submitted that the nature of allegation is general and omnibus. It is not clear as to who has assaulted the victim. It has also been submitted that due to intervention of wellwishers parties have compromised the case.

Learned APP appearing for the State has vehemently opposed the prayer of bail of the petitioners.

Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioners on bail. The

petitioners are directed to surrender in the Court below within a period of four weeks from today and in the event of their arrest or surrender in connection with Sherghati P.S. Case No. 546 of 2024, they will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1^st , District-Gaya, subject to the conditions as laid down under section 482 (2) of the B.N.S.S.
