petitioner and Mr. Sunil Kumar Pandey, learned APP for the State.

2.The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Sitamarhi (Cyber) P.S. Case No. 32 of 2024 instituted for the offence under Sections 376, 341, 323, 504, 506 of the Indian Penal Code and Section 66(C), 67(D) of the I.T. Act.

The case of the prosecution is that while the husband of the informant has gone out for his livelihood, the petitioner came closure to the informant and established relationship with her. It is also alleged that the petitioner also

established physical relationship with her and clicked obscene video as well. It is further alleged that he has also promised to marry the informant. Further allegation against the petitioner is that he has made the obscene video of the informant viral on his Instagram I.D.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has falsely been implicated in this case. He also submits that ten days prior to the instant case, a case was filed by one Aasmat Khatoon that from some fake I.D., obscene video of Najmun Khatoon (the informant) of this case is made viral. He next submits that as far as the obscene video and photo of the informant is concerned, his family members have already filed a case against it. This goes to show his bonafide. Since there is case and counter-case between the parties regarding making of video viral, the petitioner also claims that the video has been made viral from some fake I.D. and has filed a case with that effect. It has lastly been submitted that a statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent.

In contra, learned APP appearing for the State has opposed the prayer of bail of the petitioner.

Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Sitamarhi (Cyber) P.S. Case No. 32 of 2024, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi, subject to the conditions as laid down under section 438(2) of the Cr.P.C.
