Heard the learned counsel for the petitioner as well as

the learned Additional Public Prosecutor for the State.

The petitioner is seeking regular bail in connection

with Khushrupur P.S. Case No. 65 of 2021, registered for the offences punishable under Sections 147, 148, 149, 302 of the Indian Penal Code.

As per allegation, all the FIR-named and unknown accused persons, including the petitioner, surrounded the informant and asked him to sign a paper. It is further alleged that they pushed the maternal uncle of the informant and the petitioner drove the car over the abdominal region of the deceased, whereas co-accused Md. Arman Ahmad @ Dollar @ Md. Arman and co-accused Md. Faisal Khan caught hold of the

deceased.

The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He has further submitted that there is allegation that the petitioner ran over the deceased’s abdominal region with his four-wheeler but the cause of death, according to post-mortem report, is head injury, which falsifies the prosecution case. He has also submitted that the co-accused persons have been granted anticipatory bail. The petitioner is under custody since 13.04.2025.

On the other hand, the learned APP for the State has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances, let the petitioner above-named, is directed to furnish bail bond and on doing so, the court below shall release the petitioner on bail on furnishing bail bonds of Rs.10,000/with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate-Ist, Patna City in connection with Khushrupur P.S. Case No. 65 of 2021, subject to the following conditions that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
