2 17-10-2025 Heard the learned counsel for the parties.

This is an application for regular bail on behalf

of the petitioner for the offences alleged under Sections 341, 342 and 376 AB of the Indian Penal Code and Section 4/6 of the POCSO Act, registered in connection with Dhaka P.S.Case No. 46 of 2024.

According to allegation, the petitioner committed rape upon six-year-old girl.

The prayer for bail of the petitioner was earlier rejected by this Court under order dated 07.10.2024 in Cr.Misc.No. 32285 of 2024.

Mrs. Nivedita Nirvikar, the learned senior counsel for the petitioner has submitted that fresh ground for renewal of the prayer for bail is that the informant and other material

witnesses, including the victim, did not support the prosecution case during the trial. The learned senior counsel submitted further that some quarrel had taken place between the children and the victim fell down and suffered injury. The injury which has been described in the medical report might be possible on account of fall on hard surface.
