The petitioner seeks bail in connection with Laheriasarai P.S. Case No. 662 of 2024 registered for the offence punishable under Sections 21(c), 27, 29, 35 of the NDPS Act.

As per the prosecution case, 232 capsules of pyeevon tabulates and 127 pieces of Tazowine 1 ml amp has been recovered from the possession of the petitioner.

In the counter affidavit Para nos. ‘3’ and ‘4’, the State has submitted that the recovered contraband are less than small quantity. The petitioner is in jail since 24.11.2024.

This application is disposed of with direction to the learned Sessions Judge-cum-Special Judge, NDPS Act,

Darbhanga /concerned Court below to explain to the petitioner/accused the fact that the recovery is of small quantity and the maximum punishment is one year and if he pleads guilty, he may be let off after completing a particular period in custody. If the petitioner pleads guilty, appropriate order shall be passed by the Court below.

In case, the petitioner does not plead guilty, the petitioner shall be released on bail by the learned Sessions Judge-cum-Special Judge, NDPS Act, Darbhanga/concerned Court below.
