Heard learned counsel for the petitioner and learned

APP for the State.

The petitioner is in custody in connection with Ara Nawada P.S Case No. 755 of 2024 registered for the offences punishable under Sections 109(1)/3(5) of the B.N.S along with Section 27 of the Arms Act.

As per First Information Report, it is a case of firing by the petitioner along with co-accused upon the informant.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. It is further submitted that there is general and omnibus allegation against

the six persons of opening 12-15 found fire but the police had recovered only two cartridges from the place of occurrence. It is further submitted that police has submitted charge sheet against the petitioner. It is also submitted that petitioner is in judicial custody since 19.10.2024.

However, learned APP for the State oppose the prayer for regular bail of the petitioner.

On perusal of the FIR and impugned order dated 29.10.2025, allegation against the petitioner is general and omnibus in nature. There is no specific allegation against the petitioner.

Considering the aforesaid facts and circumstances of the case and submissions made on behalf of the petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M, 1^st Class, Bhojpur at Ara in connection with Ara Nawada P.S Case No. 755 of 2024.
