Heard learned counsel for the petitioners, learned APP for the State and learned counsel for the informant.

The petitioners have prayed for regular bail in a case registered for the offence punishable under sections 109/118(2)/103(1)/61(2) and 3(5) of B.N.S. and Section 27(3) of the Arms Act.

The case of the prosecution is that the informant was at his shop at that time, Shahnawaz Alam and one other entered in his shop started firing indiscriminately due to which the informant received gun shot injuries on his hand and chest. It is further alleged that Satyendra Singh was also there who objected it, on this , Shahnawaz Alam fired which hit on the head of the Satyendra Singh who died.

Learned counsels for the petitioners have submitted that the petitioners are innocent and have committed no offence. They have falsely been implicated in this case. Learned counsels for the petitioners have submitted that the name of these petitioners have surfaced in the second part of the FIR where it has been submitted that they are conspirators and there is nothing except confessional statement of Sheikh Allimullah and Shahnawaz Alam. Learned counsels for the petitioners have also submitted that one of the co-accused, namely, Sohrab Alam has

already been granted bail by learned co-ordinate Bench of this Court vide order dated 25.06.2025 passed in Cr. Misc. No. 38644 of 2025. The case of these petitioners stands on similar footing. Moreover, they are languishing in judicial custody since 05.02.2025, 11.03.2025 and 25.02.2025 respectively.

Learned APP appearing for the State and learned counsel for the informant have opposed the prayer of regular bail. Learned counsel for the informant has submitted that from perusal of the order of the trial court, it will transpire that there was role of these petitioners in conspiring the murder of the deceased.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Mirganj P.S. Case No. 56 of 2025 furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Gopalganj.
