2. The petitioner has preferred this application for grant of regular bail in connection with Begusarai Cyber P.S. Case No. 06 of 2025 dated 09.02.2025 registered for the offences punishable under Sections 316(2), 318(4), 319(2) of B.N.S. and Section 66C, 66D of I.T. Act.

3. As per the prosecution case, the petitioner along with other co-accused is alleged to have defrauded the informant and have committed cyber fraud of Rs. 1,49,373/- in five installments from the account of the informant.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

this case. It is further submitted that the petitioner has nothing to do with the alleged occurrence rather he has become a victim of the fraudulent act of cyber fraudster Dilip Kumar. It was Dilip Kumar who sent a link from his mobile number 6200097108 to the mobile number 9931392187 to recharge Rs. 10/- on Sahin Praveen’s Electric Consumer number. The petitioner is not known to Dilip Kumar or Sahin Praveen. It is further submitted that when police checked his account, he did not found any amount linked to cyber fraud. The petitioner has no concern with the alleged offence. The petitioner has no criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 06.03.2025.

Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner and submitted that the informant was defrauded by the petitioner by sending him a link from his own mobile number. In para-55 of the case diary, police has mentioned the search and seizure list in which the mobile number 6200097108 was recovered from the possession of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond

of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Begusarai in connection with Begusarai Cyber P.S. Case No. 06 of 2025, with a condition:-

(i) If the petitioner is found involved in similar nature

of offence in future, the prosecution will be at liberty to move for cancellation of his bail bond.
