Heard Learned Counsel for the petitioner and Learned APP for the State.

The petitioner is apprehending arrest in connection with Kateya P.S. Case No. 159 of 2024, lodged on 02.05.2024 for the offence punishable under Sections 420, 467 & 468 of the Indian Penal Code read with section 15(3) of the Indian Medical Council Act, 1956.

The story of the prosecution side in brief is that when an investigation of L.S. Multi-speciality Hospital was conducted by the Medical Officer in-charge, Kateya, under the instructions of the Civil Surgeon-cum-Member Secretary, District Health Committee, Gopalganj, he found that L.S. Multi-

speciality Hospital was being run by Sandeep Kumar Arya (petitioner) without any degree and registration. Thereafter, L.S. Multi-speciality Hospital was sealed as per the rules and the present case has been lodged.

Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel also submits that the petitioner has applied for a valid license, but since the license has not yet been granted, certain issues have arisen in the meantime. Counsel further submits that the petitioner is a law-abiding citizen and assures that, in the future, all legal compliance for his hospital shall be made. Counsel further submits that the petitioner has no criminal antecedent.

Learned APP for the State opposes the prayer for bail of the petitioner.

As such, in light of the submissions made by the counsel for the petitioner, let the above named petitioner be released on provisional bail in the event of arrest or surrender before the Trial Court within a period of 4 weeks from today on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) as mentioned in Section 2(1)(d) of the B.N.S.S., 2023 to the satisfaction of learned Chief Judicial Magistrate, Gopalganj, in connection with Kateya P.S. Case No. 159 of 2024, subject to

the conditions as laid down U/s 482(2) of the B.N.S.S., 2023.

It is made clear that the provisional bail of the petitioner shall be confirmed by the Trial Court only after production of substantial proof showing valid license with regard to the hospital in question of the petitioner within six months. And if, the said valid license shall not be produced by the petitioner within six months, then, provisional bail granted to him shall be cancelled.

Accordingly, the present bail application is hereby disposed off.
