APP for the State.

The petitioners seek bail in connection with Rajgir P.S. Case No. 406 of 2024 in a case registered for the offence punishable under Sections 103(1) and 3(5) of BNS, 2023.

As per allegation, the petitioners and other coaccused persons badly assaulted the deceased when he was returning to his home, along with his family members. He succumbed to the injuries in PMCH in course of the treatment.

It has been submitted on behalf of the petitioners that the petitioners are innocent and have falsely been implicated in the present case. He has further submitted that the

deceased did not raised hue and cry when he was being assaulted by the accused persons. There is delay in lodging of the FIR.

Learned APP, Mr. Shailendra Kumar has opposed the prayer for bail by submitting that the petitioners and coaccused persons assaulted the deceased when he was returning, he died during the treatment in PMCH and postmortem report corroborates the injuries inflicted on the person of the deceased.

Considering the aforesaid facts and circumstances, in my view, the petitioners do not deserve privilege of bail. Accordingly, it is rejected.
