Petitioners apprehend arrest in a case registered for

the offence punishable under sections 191(2), 190, 191(3),126(2), 115(2), 117(2), 118(1), 109, 352, 351(2) and 103(1) of the Bharatiya Nyaya Sanhita, 2023.

As per prosecution case, on account of dispute with regard to pathway, it is alleged that all the FIR named accused persons including these petitioners assaulted informant and his family members by means of Gadasa, tangi, lathi etc as a result of which Manoj Kumar, Bali Prasad and Naresh Prasad

sustained injuries. Injury of Manoj Kumar was found to be grievous, while injured Naresh Prasad died during treatment.

Learned counsel appearing for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case. Allegation of assault is general and omnibus and no specific overt act has been alleged against these petitioners. Petitioners claim clean antecedent.

Learned counsel for the State and the informant oppose the prayer for bail.

Considering the nature of accusation, prayer for bail of these petitioners is rejected.
