The petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 302 and 120(B) of the Indian Penal Code as well as Sections 25(1b-a), 26 and 27 of the Arms Act.

Learned counsel for the petitioner submits that petitioner has antecedent of ten serious cases and is in custody since 27.09.2024 and the informant alleges that on account of dispute in between the petitioner and the brother of the informant with regard to cutting of soil, the petitioner shot his brother dead on 23.04.2021 when he had gone to his field.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is further submitted that on account of dispute relating to cutting of soil, it does not appear probable that petitioner would have shot the brother of the informant.

Learned A.P.P. for the State and learned Senior Counsel appearing on behalf of the informant vehemently opposed the prayer for regular bail of the petitioner. Learned Senior Counsel for the informant submits that petitioner has antecedent of ten cases and there is direct allegation against him of committing the murder of the brother of the informant. It is further submitted that the informant would not implicate a person falsely knowing that he is not the assailant of his brother. It is further submitted that the case is of the year 2021 and the petitioner was arrested in the year 2024 only after process under Sections 82 and 83 of the Cr.P.C. was issued, as such, if privilege of bail is granted, the petitioner may abscond.

Considering the submission made by the learned Senior Counsel appearing on behalf of the informant, the Court is not inclined to release the petitioner on bail in connection with Tekari (Mau O.P.) P.S. Case No. 181 of 2021 pending in the Court of learned Judicial Magistrate-1^st Class,
