Anticipatory Bail — Disposed of with directions. Six petitioners apprehending arrest in PS Case No. 17 of 2015, P.S. Pipra, District Patna, for offences punishable under Sections 147, 148, 149, 323, 325, 337, 338, 333, 307, 353 and 427 IPC. Counsel submitted that petitioner no. 1 has five antecedent cases, petitioners nos. 2 and 4 have two each, and petitioners nos. 3, 5 and 6 have clean antecedents; that the petitioners were on police bail during investigation and the police thereafter submitted the charge-sheet; and that Mahendra Prasad Singh v. State of Bihar, 2004(3) PLJR 491, Sheochandra Singh v. State, 2007(4) BBCJ V-66, and Jagnarayan Yadav v. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 325, 337, 338, 333, 307, 353 and 427 of the Indian Penal Code.

Learned counsel appearing on behalf of the

petitioners submits that petitioner no. 1 has antecedent of five cases, petitioners no. 2 and 4 have antecedent of two cases and petitioners no. 3, 5 and 6 are persons with clean antecedent. It is

further submitted that petitioners were on police bail during the period of investigation but the police in a mechanical manner submitted charge-sheet. It is next submitted that this Court in the case of Mahendra Prasad Singh Vs. The State of Bihar reported in 2004(3) PLJR 491 , Sheochandra Singh and Others Vs. State reported in 2007(4) BBCJ V-66 and in Jagnarayan Yadav @ Babajee Yadav Son of Soti Lal Yadav and Ors. Vs. The State of Bihar reported in 2010(2) PLJR 684 has very clearly laid the law as to what steps have to be taken by the learned trial court with respect to an accused who is on police bail and after investigation charge-sheet is submitted.

In view of the submissions made by the learned counsel appearing on behalf of the petitioners, the anticipatory bail application is disposed of with a direction to the petitioners to surrender before the learned trial court on or before 04.09.2025 and the learned trial court shall on the same day dispose of the application keeping in mind the law enunciated by this Court as recorded hereinabove.

Hence, the anticipatory bail application stands disposed of.
