The petitioner seeks bail in connection with Sherghati P.S. Case No. 523 of 2024 instituted for the offences under Sections 126(2), 127(2), 115(2), 118(1)(2), 109, 74, 191(2), 190 of the Bhartiya Nyaya Sanhita, 2023.

As per prosecution case, the accusation against the accused persons including the petitioner is of assaulting the informant and her family members by means of sharp-edged like Pasuli and Gadasa . The allegation against the petitioner is of assaulting the Informant by means of Gadasa due to which her right hand got injured.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence as alleged against him and has falsely been implicated in the present case due to land dispute. He further submits that the allegation against the petitioner is of assaulting the informant by means of axe on her right hand which is not a vital part of the body and from perusal of the injury report, it appears that the same is simple in nature caused by hard and blunt substance. The specific allegation of Pasuli blow on the stomach of the brother of the informant is against the co-accused Madan Paswan which is grievous in nature. He further submits that nothing incriminating has been recovered from the conscious possession of the petitioner. The petitioner has three criminal antecedents and is languishing in judicial custody since 26.10.2024 without any rhymes or reason.

On the other hand, learned A.P.P. for the State and the Informant have vehemently opposed the prayer for grant of bail to the petitioner, stating that the offence alleged is serious in nature. Charge-sheet has been submitted in this case.

Having heard rival contention of both the parties and considering the entire facts and circumstances of the case as also taking into account the period of custody of the petitioner,

let the petitioner, abovenamed, be released on bail on furnishing bail bonds of Rs.15,000/- (Fifteen thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Sherghati P.S. Case No. 523 of 2024.
