The petitioner is apprehending his arrest in Nadi P.S.

Case No. 116 of 2020 registered under Sections-419, 420, 406, 467, 468 and 471 of the Indian Penal Code.

As per prosecution case, the co-accused Rita Devi told the informant to get the loan of Rs. 50,000/- sanctioned without a guaranter. It is further alleged that she has taken the documents from the informant and got opened an account in ICICI bank. The ATM Card and cheques were also alloted to the informant which was kept with her by said Rita Devi. On 12-072020, an amount of Rs. 9,00,000/- was credited in the account

and the same was withdrawn. Several transactions were made by said bank account. The petitioner is said to have introduced the informant with said Rita Devi.

Learned counsel for the petitioner has submitted that the petitioner is innocent and he has falsely been implicated in this case. There is nothing against him in the entire FIR. The F.I.R. shows that co-accused Rita Devi was instrumental in facilitating the loan to the informant.

On the otherhand, Mr. Shailendra Kumar, the learned Additional Public Prosecutor assisted by learned counsel for the informant has submitted that Rita Devi in her statement recorded at paragraph-13 of the case diary has stated that Keshav Sir (the petitioner) convened a meeting of Mahila Samuh and he was involved in taking and receiving the loan. The petitioner is said to have introduced Rita Devi to Dhananjay Karn and they allured Rita Devi to facilitate the said loan.

Considering the aforesaid facts and circumstances, the petitioner is not entitled for privilege of anticipatory bail and accordingly, the same is rejected .
