Heard learned counsel for the petitioner as well as

learned APP for the State.

The petitioner apprehends his arrest in connection with Complaint Case No. 238 (c) of 2023, registered for the offences punishable under Sections 498A and also under Section 4 of D.P. Act.

The complainant lodged complaint petition no. 238 (c) of 2023 stating therein that her marriage was solemnized on 03.06.2022 with the petitioner according to Hindu rituals and customs. The customary presents were given at the occasion of marriage. When she came to her matrimonial house, the accused persons started torturing her for non-fulfillment of Rs. 50,000/- as dowry and they ousted her from the matrimonial house.

The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated. No marriage was solemnized between the complainant and the petitioner. As a matter of fact, the family members of the complainant had abducted the petitioner for which the mother of the petitioner filed informatory petition in the court of C.J.M., Nalanda. The petitioner has also filed petition before the police station but the FIR was not registered.

In reply, the learned counsel for the complainant assisted by the learned APP for the State has submitted that the informatory petition has been filed but no reason has been assigned as to why the informatory petition before the court of C.J.M., Nalanda has been filed instead of filing of the complaint petition.

No reason has been assigned for non-filing of the complaint petition instead of informatory petition.

Considering the above-mentioned facts and circumstances, in my view, the petitioner doesn’t deserve the privileges for anticipatory bail. Accordingly, it is rejected.
