Petitioners apprehend arrest in a case registered for

the offence punishable under sections 126, 115(2), 109, 76, 303(2), 352, 351(3) and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

As per the prosecution case, when informant’s husband was on the shop, all the named accused persons came and started assaulting him with iron rod, lathi, danda, butt of pistol and when informant tried to save him, these petitioners tore her blouse. Accused persons took Rs.40,000/- from the shop and snatched gold locket from the informant.

It is submitted on behalf of the petitioners that due to previous enmity, simple marpit took place between the

parties. Case and counter case. Allegation of assault is general and omnibus and no specific overt act has been alleged against these petitioners. Though there is allegation of assault, but no injury report is on the record.

Learned counsel for the State opposes the prayer

Considering the aforesaid facts of the case, prayer for bail of all the petitioners is allowed. In the event of arrest/surrender within eight weeks from today, let these petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in Raghopur Police Station Case No. 299 of 2024, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
