Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State.

The petitioner is seeking regular bail in connection with Laukahi P.S. Case No. 225 of 2024, registered for the offences punishable under Sections 310(4), 310(5) of the BNS and Sections 25(1-B)a/26/35 of the Arms Act.

Allegedly, 120 bottles, 100 ml each of ONEREX

Cough Syrup were recovered from the shop of the petitioner.

The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He has further submitted that arms and ammunition were recovered from other co-accused persons and not from possession of the petitioner. So far as recovery of cough syrup from the shop of petitioner is concerned, he runs a medical

store, and has stored cough syrup for sale. He has also submitted that the petitioner is a person of clean antecedent and is under custody since 21.12.2024.

On the other hand, the learned APP for the State has opposed the prayer for bail and submitted that a huge quantity of cough syrup was recovered from the shop of the petitioner.

Considering the above-mentioned facts and circumstances especially the clean antecedent of the petitioner, let the petitioner above-named, is directed to furnish bail bond and on doing so, the court below shall release the petitioner on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Principal Sessions Judge, Madhubani in connection with Laukahi P.S. Case No. 225 of 2024, subject to the following conditions that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
