Heard learned counsel for the petitioner and

learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 329(3), 111, 109, 303(2), 308(2), 308(5), 352, 351(2) and 3(5) of the B.N.S.

Learned counsel for the petitioner submits that petitioner has antecedent of six cases. It is next submitted that out of six cases, four cases have been instituted by the brother of the informant. It is next submitted that the informant alleges that he along with the villagers went to plough the field when accused persons including the petitioner came and demanded extortion of Rs.2 lacs, thereafter Narayan Yadav fired but then he missed and no one was injured. It is next alleged that

informant fears for his life as Narayan and Jawahar are an accused in murder case of Murli Master committed in the year 2009. It is also alleged that he gave Rs.15,000/- to Narayan.

The learned counsel submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that from perusal of the allegation as alleged in the F.I.R., it would manifest that no specific allegation is alleged against the petitioner. It is also submitted that Title Suit No.72/2015 is pending in between the brother of the petitioner and informant. It is next submitted that the date of occurrence is 22.12.2024 and the F.I.R. came to be instituted on 24.12.2024 i.e. after a delay of two days without any plausible explanation. It is next submitted that on account of dispute relating to land, the informant and his family members are in habit of implicating petitioner and his family members.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/-
